§ 1 Scope
These Terms and Conditions of Sale apply to all orders placed by consumers through the online store of LYRAVYOR M31 by heimatseiten.

§ 2 Products
LYRAVYOR M31 offers carefully curated physical products and, where indicated, digital products.
The product range includes, in particular:

• Complementary Products and Accessories
   

All product descriptions and images are prepared with the greatest possible care. However, slight variations in colour may occur due to differences in screen settings and display technologies.
 
Natural gemstones and crystals are unique products of nature. Variations in colour, structure, transparency, size, shape or naturally occurring inclusions are characteristic features of the material and do not constitute defects.
 
§ 3 Conclusion of Contract
The presentation of products in the online store does not constitute a legally binding offer.
By clicking the "Place Order with Obligation to Pay" button, you submit a binding offer to purchase the selected products.
After your order has been received, you will automatically receive an order confirmation by e-mail. This confirmation merely acknowledges receipt of your order and does not yet constitute acceptance of your offer.
 
The purchase contract is concluded only when we:
 

• expressly confirm your order,

• dispatch the ordered goods, or

• make digital content available for download.
   

Should a product exceptionally become unavailable, we will inform you without undue delay. Any payments already made will be refunded promptly.
 
§ 4 Prices
All prices are stated in Euro (€).
As a small business pursuant to Section 19 of the German Value Added Tax Act (UStG), no value added tax (VAT) is charged or shown separately.
Any applicable shipping costs are displayed separately during the checkout process.
No shipping costs apply to digital products.
The prices valid at the time of placing your order shall apply.
 
§ 5 Payment
Payment can be made using the payment methods offered during the checkout process.
Payments are securely processed via Wix Payments. Depending on your location, available payment methods may include PayPal, credit card and other payment options supported by Wix Payments.
Your selected payment method will be charged in accordance with the terms and conditions of the respective payment service provider.
We reserve the right to restrict or refuse individual payment methods where objectively justified.
 
§ 6 Shipping and Delivery
Orders are shipped exclusively via Hermes.
All shipments include parcel tracking.
Shipping costs and estimated delivery times are displayed before you complete your order.
Should unexpected delivery delays occur, we will inform you as soon as possible.
The risk of accidental loss or accidental damage passes to you only upon delivery of the goods to you or to a person authorised to receive them.
 
§ 7 Retention of Title
The delivered goods remain our property until full payment has been received.
 

§ 8 Gift Cards

Where gift cards are offered in the online store, the following provisions shall apply.

Gift cards may only be redeemed for products available in the LYRAVYOR M31 online store.

Cash payment of the gift card value is excluded.

If the value of the gift card is insufficient to cover the total purchase amount, the remaining balance may be paid using one of the payment methods offered during checkout.

Any remaining gift card balance will remain available and may be used for future purchases within the applicable statutory validity period.

Gift cards are transferable. LYRAVYOR M31 may fulfil its obligation by accepting redemption from the person presenting the gift card in the online store.

§ 9 Digital Content

Digital products are made available after successful payment in the form described in the respective product description.

This may include, for example, a download, digital access or electronic delivery.

Digital content is provided exclusively for your personal use.

Without the prior written consent of LYRAVYOR M31, digital content may not be copied, shared, distributed, published, modified or used for commercial purposes.

Where permitted by law, the statutory right of withdrawal for digital content expires once performance of the contract has begun, provided that you have expressly agreed before completing your purchase that the digital content will be supplied before the withdrawal period expires and have acknowledged that you thereby lose your right of withdrawal.

§ 10 Intellectual Property Rights

All content available through the online store and all content included with LYRAVYOR M31 products is protected by copyright, trademark law, design rights or other applicable intellectual property rights, where legally permissible.

The purchase of a product transfers ownership of the physical product only.

All copyrights, trademark rights, design rights and other intellectual property rights remain exclusively with LYRAVYOR M31 or the respective rights holder.

No content may be reproduced, published, distributed, digitised, modified or used for commercial purposes, whether in whole or in part, without prior written permission.

§ 11 Statutory Warranty

The statutory warranty rights under applicable law shall apply.

As natural gemstones and crystals are unique products of nature, natural variations in colour, shape, structure, transparency or size do not constitute defects.

Should you nevertheless have any reason for complaint, we encourage you to contact us so that we can work together to find a fair and satisfactory solution.

§ 12 Liability

LYRAVYOR M31 shall be fully liable for damages resulting from intent or gross negligence.

In cases of slight negligence involving the breach of essential contractual obligations, liability shall be limited to the foreseeable damage typically expected under the contract.

These limitations of liability shall not apply in cases involving injury to life, body or health, or where liability is mandatory under applicable law.

§ 13 Information about LYRAVYOR M31

LYRAVYOR M31 is a system designed to support conscious alignment, personal reflection and inner development.

Its products are intended to encourage individual awareness, mindfulness and self-reflection.

They are not medical, psychotherapeutic or therapeutic treatments.

The products and content offered by LYRAVYOR M31 do not replace medical, psychotherapeutic or professional healthcare diagnosis, advice or treatment.

References to resonance, energy, frequency or consciousness describe the conceptual framework of the system and are not to be understood as scientifically proven claims of effectiveness.

The use of LYRAVYOR M31 is your own responsibility.

§ 14 Final Provisions

These Terms and Conditions shall be governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), unless mandatory consumer protection provisions require otherwise.

Should any provision of these Terms and Conditions become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
